FreshBrain Privacy Policy
FreshBrain, Inc. ("FreshBrain", "we" or "us") provides this Privacy Policy to inform you of our policies and procedures regarding the collection, use and disclosure of personal information we receive from users of freshbrain.org (this "Site"). This Privacy Policy applies only to information that you provide to us through this Site. Our Privacy Policy may be updated from time to time, and we will notify you of any material changes by posting the new Privacy Policy on the Site. Unless otherwise defined in this Privacy Policy, terms used here have the same meanings as in our FreshBrain Terms and Conditions of Use Agreement.
1. Information Collection: The Personally Identifiable Information We Collect
In the course of using the Site, you may provide us with personally identifiable information. This refers to information about you that can be used to contact or identify you, and information on your use of and activities at our Site that may be connected with you ("Personal Information"). Personal Information that we collect may include, but is not limited to, your name, email address and postal addresses. Personal Information may also include information you supply to us concerning your preferences and interests expressed in the course of your use of the Site or your participation in a project. We encourage users to use a nickname when they choose their username.
- When you visit the Site, our servers automatically record information that your browser sends whenever you visit a website ("Log Data"). This information may include, but is not limited to, your computer's Internet Protocol address, browser type, the web page you were visiting before you came to our Site and information you search for on our Site. Like many websites, we also use "cookies" to collect information. A cookie is a small data file that we transfer to your computer's hard disk for record-keeping purposes. We use "persistent cookies" to save your username and login password for future logins to the Site; and we use "session ID cookies" to enable certain features of the Site, to better understand how you interact with the Site and to monitor aggregate usage and web traffic routing on the Site. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Site or all functionality of our services.
2. How We Use Personal Information
Personal Information is used for the following purposes: (i) to provide and improve the Site, services, features and content, (ii) to administer your registration, your use of the Site and involvement and execution of projects and participation in a Promotion (defined below) , (iii) to enable users to enjoy and easily navigate the Site, (iv) to better understand your needs and interests, (v) to fulfill requests you may make, (vi) to personalize your experience, and (vii) to provide you with further information and offers that we believe you may find useful or interesting, including newsletters, educational or promotional materials and other information about the FreshBrain community. If you decide at any time that you no longer wish to receive such communications, please follow the unsubscribe instructions provided in any of the communications or update your "user preferences" information. (See "Changing or Deleting Information" below.)
We use information we obtain by technical means (such as the automatic recording performed by our servers or through the use of cookies) for the above purposes (i.e., Section 2; paragraph No. 1) and in order to monitor and analyze use of the Site and our services and for the Site's technical administration, to increase our Site's functionality and user-friendliness, to better tailor it to your needs, to generate and derive useful data and information concerning the interests, characteristics and website use behavior of our users and to verify that visitors to the Site meet the criteria required to process their requests.
We may operate sweepstakes, contests and similar promotions (collectively, "Promotions") through the Site. We typically ask you for certain Personal Information when you enter and, if applicable, win a Promotion. You should carefully review the rules of each Promotion in which you participate through the Site, as they may contain additional important information about FreshBrain's use of your Personal Information. To the extent that the terms and conditions of such rules concerning the treatment of your Personal Information conflict with this Privacy Policy, the terms and conditions of such rules shall control.
3. Information Sharing and Disclosure
FreshBrain Members. In addition to your username, any comments or submissions that you post to the Site or any information that is flagged as "public" in your user profile will be publicly available. Any information in your profile that is flagged as "friends only" will be visible only to those users who you designate as "friends". Any information you choose to provide in a comment or a submission (e.g., as part of a project, or as posted in a discussion board or forum) should reflect how much you want other users to know about you. We recommend that you guard your anonymity and sensitive information and we encourage FreshBrain Members to think carefully about what information about themselves they disclose to others via their comments or submissions or otherwise.
Aggregate Information and Non-Identifying Information. We may share aggregated information that includes non-identifying information and Log Data with third parties for industry analysis and demographic profiling. This information will not contain your Personal Information.
Service Providers, Business Partners and Others. We may employ third party companies and individuals to facilitate our service, to provide the service on our behalf, to perform Site-related services (including but not limited to maintenance services, database management, web analytics and improvement of the Site's features) or to assist us in analyzing how our Site and service are used. These third parties have access to your Personal Information only for purposes of performing these tasks on our behalf.
Compliance with Laws and Law Enforcement. FreshBrain cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of FreshBrain or a third party, to protect the safety of the public or any person, or to prevent or stop any activity we may consider to be, or to pose a risk of being, illegal, unethical, inappropriate or legally actionable.
Business Transfers. FreshBrain may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.
4. Changing or Deleting Your Information
All FreshBrain Members may review, update or correct the Personal Information provided in their registration or account profile by changing their "My FreshBrain"; "Personal Profile" under "Edit" If you completely delete all such information, then your account may become deactivated. You may also completely delete your account by sending an email to webmaster@freshbrain.org.
5. Invite your Friends
All FreshBrain Members may invite others to take a look at the site, register and participate. This is done from under the "Invite Friend to FreshBrain" link. If you choose to invite a friend to FreshBrain via your account, we will ask you for your friend's name and email address. We will automatically send your friend a one-time email inviting him or her to visit the Site. We store this information for the sole purpose of sending this one-time email and tracking the response. This information is not used for any other purpose.
Your friend may contact us at webmaster@freshbrain.org to request that we remove this information from our database.
6. Invite a Friend to Join Your Project
All FreshBrain Members who are doing a project may invite others to take a join their project. This is done from under the "Invite Friend to Project" link on the project page. If you choose to invite a friend to FreshBrain via your account, we will ask you for your friend's name and email address. We will automatically send your friend a one-time email inviting him or her to visit the Site. We store this information for the sole purpose of sending this one-time email and tracking the response. This information is not used for any other purpose.
Your friend may contact us at webmaster@freshbrain.org to request that we remove this information from our database.
7. Security
FreshBrain is very concerned with safeguarding your information. We employ reasonable measures designed to protect your information from unauthorized access.
8. Our Policy Toward Children
We do not knowingly collect personally identifiable information from children under 13. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us at privacy@freshbrain.org . If we become aware that a child under 13 has provided us with Personal Information, we will delete such information from our files.
9. International Transfer
Your information may be transferred to ”and maintained on” computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to FreshBrain, please be advised that we transfer Personal Information to the United States and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
10. Links to Other Sites
Our Site contains links to other websites. If you choose to visit an advertiser by "clicking on" a banner ad or other type of advertisement or click on another third party link, you will be directed to that third party's website. The fact that we link to a website or present a banner ad or other type of advertisement is not an endorsement, authorization or representation that we are affiliated with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit personal information from you. Other sites and services follow different rules regarding the use or disclosure of the personal information you submit to them. We encourage you to read the privacy policies or statements of the other websites you visit.
